By downloading, installing, or using Hertz Labs (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a binding agreement between you and Engine Labs ("we", "us", "our").
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission.
⚠ Important. Hertz Labs is an audio generation and wellness tool. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Do not use the App as a substitute for professional medical care. Consult a qualified health professional before use if you have any medical condition, including but not limited to epilepsy, hearing disorders, or cardiac conditions.
Audio entrainment at certain frequencies may affect neurological activity. Do not use the App while driving, operating machinery, or in any situation where reduced attention poses a risk.
Hertz Labs offers optional Premium subscriptions and a lifetime purchase, processed through the Apple App Store, Google Play Store, and managed by RevenueCat.
The App includes a Feedback menu with options to report bugs, request features, apply to become an affiliate, or connect with us for general inquiries. Messages are sent through our servers to support@enginelabs.com.au or hello@enginelabs.com.au. You may optionally provide your email address for a reply; affiliate applications require an email address. Device and app version metadata may be attached automatically to help us investigate issues.
The Promos hub lists optional activities (such as streak milestones, referrals, reviews, and challenges) that may entitle you to official App Store Offer Codes or Google Play promo codes after you complete the stated activity. Rewards are subject to availability, manual review where noted, and our anti-abuse rules. Store offer codes must be redeemed through Apple or Google’s official redemption flows — not via custom in-app coupon strings. We do not guarantee that any promo will remain available at all times. Incentivised store review prompts, where offered, require you to open the store review flow in good faith; we do not condition rewards on the content or star rating of any review.
The in-app Become an affiliate form is an application for a separate business partnership program documented at our Affiliate Program page. Submitting an application does not guarantee acceptance, any earnings, or Premium access. Commission, attribution, and payouts for approved partners are governed by a written agreement outside these Terms. Cash commissions are not paid through the App’s in-app purchase system.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes on Apple devices you own or control, subject to these Terms and the Apple App Store Terms of Service.
You may not: copy, modify, distribute, sell, or sublicense any part of the App; reverse engineer or attempt to extract source code; use the App to build a competing product; or use the App in any unlawful manner.
⚠ Photosensitivity. The optional photic strobe syncs trace colours on the oscilloscope to your beat frequency. It is off by default and requires explicit consent before first use. Do not enable if you have epilepsy, a history of seizures, migraine with aura, or photosensitivity. You can disable it at any time from the control above the oscilloscope.
Optional Guided Depth presets provide self-directed relaxation scripts paired with entrainment and breath pacing — not clinical hypnosis or medical treatment. Optional ASMR texture layers are procedural audio stems mixed under the tone; they do not replace professional care. Stop any session if you feel unwell.
The Promos Refer a Friend flow issues you a personal HZ referral ID (not an App Store or Google Play offer code). Friends must manually enter your HZ code on Plans → Referral after install. When a valid referral is accepted, both parties may receive official store offer codes from our pool, subject to availability and anti-abuse rules. Referral terms are shown in the Promos info sheet. Purchase-upgrade bonuses for referrers are tracked via our backend and RevenueCat subscriber attributes — not via App Store Connect referral products.
If you allow notifications, the App may schedule local reminders about daily streaks, streak restore offers, and promotional campaigns you are eligible for. We do not send marketing push notifications from our servers in the current release; codes are claimed in-app after you open the App. You can disable streak or promotional reminders in Settings where available.
The optional in-app Focus Challenge requires consecutive daily sessions and a short reflection questionnaire. Rewards are issued only after Day 30 completion via official store offer codes. Missing a day without a challenge shield resets progress. Challenge copy is wellness-oriented and makes no medical outcome promises.
If you attempt to manage or cancel a subscription, we may show an optional winback offer with an official App Store or Google Play offer code before redirecting you to the store subscription management UI. Offers are limited per subscription period; dismissing the modal does not cancel your subscription — you must cancel in Apple or Google settings.
The AI Guide feature uses Google's Gemini API to generate frequency recommendations based on your text prompts. Recommendations are generated automatically and may be inaccurate or unsuitable. They do not constitute medical advice. We are not responsible for outcomes resulting from following AI suggestions.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability.
To the fullest extent permitted by law, Engine Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
We may update the App or these Terms at any time. Continued use after changes constitutes acceptance. We will update the "Last updated" date when material changes are made.
These Terms are governed by the laws of Australia, without regard to conflict of law principles.
